Introduction and Acceptance of Terms

Welcome to Hunters Mindset, a content and community platform dedicated to helping hunters “stay capable for the long hunt.” These Terms of Use (“Terms”) govern your access to and use of the Hunters Mindset website, content, and community features (the “Platform”). By accessing or using our Platform, you agree to these Terms. If you do not agree, please do not use the Platform. Hunters Mindset (“we” or “us”) is based in North Carolina, USA, and our contact email is info@huntersmindset.com. We reserve the right to update these Terms from time to time; we will notify users of any material changes by posting the updated Terms with a new effective date.

Accounts and Membership

To access certain features (such as member-only articles or forum participation), you may need to create an account or purchase a membership (e.g., The Long Hunt paid membership). You agree to provide accurate, current information during sign-up and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. If you suspect any unauthorized use of your account, notify us immediately.

Membership Fees and Payment: Paid memberships and subscriptions are processed via Stripe. By subscribing, you authorize us (and Stripe) to charge the applicable membership fees to your provided payment method. Membership subscriptions may renew automatically (e.g., monthly or annually) unless you cancel. You can cancel your paid membership at any time; cancellation will stop future billing, but (unless required by law) we do not provide pro-rated refunds for any remaining period of a subscription. If a payment cannot be processed, we may suspend or terminate your access to paid features.

Permitted Use of Content

All articles, checklists, podcasts, guides, and other content provided on the Platform are for your personal, non-commercial use. You may download or print content for your own reference, but you may not copy, distribute, republish, or exploit our content for any commercial purpose without our express written permission. Hunters Mindset is a member-supported, ad-free platform, and we appreciate you respecting the intellectual property rights in our content.

Intellectual Property: Unless otherwise noted, the Platform and all content on it are owned by Hunters Mindset or our content creators and are protected by copyright, trademark, and other intellectual property laws. The name “Hunters Mindset,” our logos, slogans, and any custom graphics are trademarks/service marks of Hunters Mindset. You agree not to use our trademarks or content in any way not permitted by these Terms.

User Conduct and Community Guidelines

We strive to maintain a respectful, peer-supported community. When participating in our Discourse-powered forums or any community feature, you agree to conduct yourself in a manner that is courteous, lawful, and aligns with our values of responsibility and respect. By using the community areas, you agree that you will NOT:

  • Harass, threaten, abuse, or demean other members. This includes no defamation, personal attacks, or discriminatory language.
  • Post content that is unlawful, obscene, pornographic, hateful, or otherwise objectionable. Content should remain on-topic to hunting, training, and related discussions.
  • Share content that violates any third-party’s rights, including intellectual property rights or privacy rights. (For example, do not upload images or text that you don’t have the right to share.)
  • Post spam, advertisements, or solicitations for products, services, or external ventures. Our community is ad-free and sponsor-free, so any form of advertising or promotion should be avoided unless expressly allowed.
  • Impersonate any person or entity, or misrepresent your affiliation with anyone. Be honest about who you are in the community (pseudonyms are fine, but do not pose as someone else).
  • Attempt to collect personal information of others without their consent, or encourage any form of phishing, data mining, or intrusive activities.
  • Engage in any activity that could disrupt or interfere with the functioning of the Platform or other users’ ability to use it (such as distributing viruses, DDOS attacks, or attempting to hack or gain unauthorized access to restricted areas).

These guidelines (along with any posted Community Rules or Code of Conduct) are meant to keep the space safe and useful for everyone. We reserve the right to moderate posts and content. We may edit or remove any user content that violates these rules or for any other reason in our sole discretion. Repeated or severe violations may result in suspension or termination of your community privileges or account.

Always use caution and common sense when sharing personal information about yourself in the forums. Remember that information you post in the community may be visible to other members of the Platform. We are not responsible for how other users may use information you voluntarily share in public areas.

User Content and License

By posting or submitting any content (such as forum posts, comments, images, or feedback) on the Platform (“User Content”), you retain ownership of your content. However, you grant Hunters Mindset a worldwide, non-exclusive, royalty-free license to use, display, reproduce, distribute, and adapt your User Content within our Platform and in any promotional materials for the Platform. This license is solely for the purpose of operating, showcasing, and improving the community and our services.

You represent and warrant that you have all necessary rights to post your User Content and that sharing your content does not violate any laws or rights of others. Hunters Mindset does not pre-screen user posts, and we are not responsible for what users post. The views expressed by community members are their own and do not necessarily reflect our views. We specifically disclaim any liability for User Content – you use the community information and interactions at your own risk.

If you believe another user’s content violates these Terms or your rights (for example, infringes your copyright or is otherwise unlawful), please contact us at info@huntersmindset.com with details. We will investigate and take appropriate action, which may include removal of the content or other remedial steps as required or permitted by law.

Disclaimers (Informational Use and Assumption of Risk)

Informational Purposes Only: All content provided by Hunters Mindset – including articles, guides, checklists, podcasts, and forum discussions – is for informational and educational purposes only. It is not professional advice. Specifically, nothing on our Platform constitutes medical, fitness, legal, or professional advice for your particular situation. Any recommendations on training, exercise, nutrition, or hunting practices should be taken as general information – always use your own judgment and consider consulting with a qualified professional (such as a doctor, fitness trainer, or safety instructor) before implementing any actions.

No Guarantees of Results: Every hunter is different, and results or outcomes will vary. We make no guarantees that following any tips or strategies from our content will ensure any particular outcome (such as improved physical performance, a successful hunt, or prevention of injury). You are responsible for evaluating the suitability of the information for your needs.

Assumption of Risk: Hunting, physical training, and outdoor activities carry inherent risks, especially for individuals with injuries or health conditions. By using the information on our Platform, you acknowledge and agree that you assume all risks to your health, safety, and well-being that may result from applying the content. This includes the risk of injury, illness, or other harm. For example, if you undertake a fitness regimen or a backcountry hunt preparation plan based on our content, you do so voluntarily and at your own risk. Always ensure you have appropriate skills, take necessary safety precautions, and do not push beyond your limits. Coming home safe is ultimately your responsibility.

Not a Medical or Safety Provider: Hunters Mindset is not a medical organization, healthcare provider, or certified training institution. The content we provide is based on personal experience, peer advice, and research, but it should not be relied upon as a substitute for professional medical evaluation or hands-on training. If you have any health concerns or questions about your ability to perform certain activities, consult a physician or relevant professional. Similarly, for firearms, bow handling, and wilderness survival, official courses and certifications are recommended in addition to any informal advice from our community.

Warranty Disclaimer

Hunters Mindset provides the Platform and all content “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties of any kind – whether express, implied, or statutory – regarding the Platform and content. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that: (a) the content is accurate, reliable, or up-to-date (though we strive for accuracy and periodically update content); (b) the Platform will be available at any particular time or location, or uninterrupted, secure, and error-free; or (c) any errors or defects will be corrected.

No information or advice (written or oral) obtained by you from Hunters Mindset or through the Platform shall create any warranty not expressly stated in these Terms. You accept that any reliance on the information on our Platform is at your own discretion and risk. Remember that advice received via any website (ours included) may not perfectly apply to your personal circumstances – when in doubt, seek personalized professional advice.

Limitation of Liability

To the maximum extent permitted by law, Hunters Mindset (and its founder, contributors, employees, or affiliates) will not be liable for any indirect, incidental, special, consequential, or exemplary damages arising from or related to your use of the Platform or reliance on its content. This includes, for example, damages for personal injuries, accidents or health issues, lost profits, lost data, or costs of procuring substitute services, even if we have been advised of the possibility of such damages.

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages, our liability will be limited to the greatest extent permitted by law. Your sole and exclusive remedy for dissatisfaction with the Platform or content is to stop using the Platform.

If, notwithstanding the above, Hunters Mindset is found liable to you for any claim arising out of or related to the Platform or these Terms, our aggregate liability to you will not exceed the total amount you paid us (if any) for the applicable services or content in the past six (6) months. Because some jurisdictions do not allow the exclusion or limitation of liability, the above limitation may not apply to you in full – in such cases, our liability is limited to the minimum amount permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless Hunters Mindset, its owner/founder, employees, contributors, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with: (a) your violation of these Terms or any applicable law; (b) your User Content or any content you post or share on the Platform (including any claims that your content infringes or misuses any third-party rights or violates law); (c) your use of the Platform or reliance on any content; or (d) any interactions or disputes between you and other users. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (in which case you agree to cooperate with our defense of such claim), but doing so will not excuse your indemnity obligations.

Hunters Mindset relies on certain trusted third-party services to operate our Platform effectively. By using our Platform, you acknowledge that your information and usage may be shared with or processed by the following third parties under their respective terms and privacy policies:

  • Discourse (Forum Software) – We use the Discourse platform to power our community forums. If you participate in the forums, your forum account data (such as username, email, profile information, and posts) is stored on the Discourse system. Discourse is provided by a third-party, and your use of the forum may also be subject to Discourse’s own terms of service. We do not control Discourse’s software or updates, so there may be times the forum service has its own downtime or changes outside our control.
  • Ghost (Publishing and Membership Platform) – Our website and newsletter operate on Ghost, which manages content publishing, email distribution, and membership management. When you subscribe to our newsletter or sign up for membership, Ghost’s platform processes your sign-up information and email to send you content and updates. Ghost may also employ built-in analytics (e.g., to let us know email open rates or site visits).
  • Stripe (Payment Processing) – We use Stripe to handle all payment transactions for memberships. When you enter payment information, it is processed securely by Stripe. We do not store your credit card numbers or sensitive payment details on our servers. Stripe may handle your billing address, card info, and payment history, subject to Stripe’s own privacy policy and security standards. By making a purchase, you agree to Stripe processing your payment and you are subject to Stripe’s terms.
  • Other Links – The Platform or users may occasionally share links to third-party websites or resources (for example, a recommended external article, a gear vendor, etc.). We provide these links for convenience and do not endorse or have control over those websites. We are not responsible for the content, products, or practices of any third-party websites. When you follow a link to an external site, you do so at your own risk and should review that site’s own terms and policies.

Each of these third-party services has its own terms and privacy practices. We encourage you to read their Terms of Service and Privacy Policies to understand how they handle your data. Hunters Mindset is not liable for any acts or omissions of third-party service providers. However, if you encounter an issue with any integrated service (such as a billing problem with Stripe or a technical issue with the forum), you can contact us and we will do our best to assist or direct you to the appropriate support.

Termination

Termination by You: You are free to stop using our Platform at any time. You may also delete your account or cancel your membership if you wish to terminate your relationship with Hunters Mindset. (We’d appreciate feedback on why, as we aim to improve, but that’s optional.)

Termination or Suspension by Us: We reserve the right to suspend or terminate your access to the Platform (including any account or membership) at any time, with or without notice, for any conduct that we, in our sole discretion, believe is disruptive, in violation of these Terms, damaging to our community, or for non-payment of fees. For example, if you seriously violate our Community Guidelines or engage in fraudulent or unlawful activities, we may ban your account. In the event of termination due to your breach of these Terms or misconduct, you will not be entitled to any refund of fees paid.

After termination (by either party), the provisions of these Terms that by their nature should survive will remain in effect. This includes sections related to Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and any licenses you granted to your User Content (we may retain copies of your posts as part of the forum history, for example, unless you request deletion and it complies with our policies to remove it).

Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of the State of North Carolina, USA, without regard to its conflict of law principles. By using the Platform, you agree that any dispute arising from or related to these Terms or the Platform will be subject to the exclusive jurisdiction of the state or federal courts located in North Carolina. You consent to personal jurisdiction and venue in such courts.

International Use: Hunters Mindset is operated from the United States. We make no representations that the Platform is appropriate or available for use in other locations. Those who choose to access the Platform from outside the USA do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws apply.

Disclaimer for Hunting and Firearms

(Because our community involves discussions of hunting, weapons, and outdoor survival, we include this additional clarification.) Firearm safety and hunting regulations are paramount. Nothing on our Platform should be interpreted as overriding official safety rules, local hunting laws, or common sense practices. Always follow the four primary rules of firearm safety and any legal requirements for your hunting activities. Hunters Mindset is not responsible for any misuse of firearms or equipment, or any legal violations that users may commit after consuming content on our Platform. When in doubt, err on the side of safety and consult official sources or certified instructors.

Changes to These Terms

We may update or modify these Terms of Use from time to time as our platform evolves or legal requirements change. If we make material changes, we will notify members via email or by posting a prominent notice on our site. The “Last Updated” date at the bottom indicates when the latest modifications were made. By continuing to use the Platform after any changes become effective, you agree to be bound by the revised Terms. If you do not agree to the updated terms, you must stop using the Platform.
